With the Smart Car due to launch in the US here in 2008, aren't you the least bit curious who took delivery of the first one? Well the answer may surprise you. The Smart Car is not new to the United States at all.

Smart has been seesawing whether to enter the US market since the release of the fortwo coupe in 1998. Initially they "test-marketed" the car in the US and found publicly that US consumers were more interested in SUVs. Then, they established a Smart USA operation and nearly completed the full engineering of an SUV Smart formore that they announced would be unveiled in 2004 at the Detroit Auto Show.

ZAP to Take Daimler Smart Car Lawsuit to California Supreme Court

LOS ANGELES -- February 25, 2008 -- Electric car maker ZAP (OTCBB:ZAAP) filed a lawsuit against DaimlerChrysler, Smart Car and various officials on October 28, 2005, alleging severe misconduct attempting to destroy ZAP's business model to bring the affordable and environmentally friendly smart fortwo to the US public.

Following a procedural ruling by the trial court and the court of appeals that the defendants were not subject to the jurisdiction of the California courts, ZAP has announced its intentions to bring the matter to the California Supreme Court for resolution.

ZAP Awaits Court Decision on California Jurisdiction for Smart Car Lawsuit

LOS ANGELES, CA -- Nov 15, 2007 -- A lawsuit filed by California electric car maker ZAP (OTC BB:ZAAP.OB) against DaimlerChrysler, Smart GMBH and Smart Chairman Ulrich Walker is awaiting a decision before a Court of Appeal to proceed in California court.

Yesterday the Court of Appeal for the State of California heard oral arguments on ZAP's claims against DaimlerChrysler, Smart GMBH and Smart Chairman Ulrich Walker. Specifically, the Court will decide whether ZAP's claims against these parties may proceed in the California courts. The trial court found in June of 2006 that no jurisdiction existed to permit California court to hear ZAP's suit. ZAP is confident that this procedural error will be reversed. A decision is expected within 90 days.

SANTA ROSA, Calif.--July 20, 2006--Automotive pioneer ZAP (NYSE Arca:ZP) announced today that it has reached an agreement to acquire all ownership interest from Smart Automobile LLC for the intellectual property that helped engineer the Smart Car Americanized for ZAP to meet U.S. Department of Transportation (DOT) compliance.
